1. Terms of sale
1.1. The terms of sale apply to the purchase of goods and services from the Palkmajakeskus online store www.palkmajakeskus.ee.
1.2. In addition to these terms and conditions of sale, the legal relationships arising from the purchase of products from the Online Store are governed by the Law of Obligations Act (hereinafter VÕS), the Consumer Protection Act (hereinafter TKS) and other relevant legislation in the Republic of Estonia.
1.3. Palkmajakeskus reserves the right to make changes and additions to the conditions of sale without notice.
1.4. The images of the products in the online store are illustrative and may differ from the actual products.
1.5. There may be unintentional errors in the description of the products in the online store.
1.6. Palkmajakeskus has the right to withdraw from the sales contract concluded through the online store without sanctions (without giving additional explanations) and to not hand over the ordered goods or not provide the service in the following cases: a) the goods are out of stock; b) the price or characteristics of the goods have been displayed incorrectly in the online store due to a system error; c) if the customer does not meet the conditions established by Palkmajakeskus. If Palkmajakeskus is unable to fulfill the order, Palkmajakeskus will contact the customer and return the purchase amount paid within 14 days at the latest (if the customer has paid for the goods).
2. Prices
2.1. All prices in the Palkmajakeskus online store are in euros (EUR) and include valid VAT 20%.
2.2. The cost of transportation is added to the price according to the delivery method chosen by the customer (except for campaigns or coupons).
2.3. Prices are valid from the time the order is placed until the payment deadline for the placed order expires (3 days after the order is placed).
2.4. To pay for orders, the customer has the option to choose a payment method: a) by bank transfer on the basis of an invoice or b) bank link.
2.5. When paying with a bank link, Palkmajakeskus transfers the personal data necessary to make the payment to the authorized processor (e.g. Montonio Finance UAB).
3. Forming the order
3.1. Add the desired product to the shopping cart by pressing the "Add to cart" button.
3.2. To see the contents of the shopping cart, select "Shopping cart" from the top right corner of the website.
3.3. To complete the order, choose the appropriate method of delivery of the products and click "Pay". You can choose a suitable parcel machine in the next step.
3.4. After selecting the mode of transport and the destination, fill in the required data fields with your data.
3.5. After entering the data, choose the appropriate payment method.
3.6. To confirm the order, check the option "I agree to the privacy and sales conditions" and then select "I place the order and pay".
3.7. Orders placed in the online store Palkmajakeskus are handled on working days from 10:00 a.m. to 4:00 p.m. The preparation of the order for transport can take up to 48 hours.
3.8 Orders submitted on public holidays are completed on the following business day, unless otherwise notified.
4. Entry into force of the sales contract
4.1. With the sales contract, Palkmajakeskus undertakes to hand over the existing, manufactured or future acquired goods to the customer and to enable the transfer of ownership to the customer.
4.2. The customer undertakes to pay Palkmajakeskus the amount indicated on the invoice for the goods and to accept the ordered goods.
4.2. Orders that have not been paid for will be canceled after 3 working days from the order, unless otherwise agreed.
4.3. The sales contract comes into effect when the customer's payment is received in the Palkmajakeskus cash desk or bank account (also after the conclusion of the installment agreement).
5. Delivery
5.1. After the sales contract enters into force, the ordered goods can be received in the following ways:
5.1.1. The goods are sent to the Smartpost, Omniva or DPD parcel machine chosen by the customer.
5.1.2. The courier company delivers the goods to the address specified in the order. Courier service applies if the dimensions of the goods exceed the dimensions of the parcel machine or the weight limit. Shipments with a total weight of up to 30 kg are delivered by the courier to the door of the apartment, house or garage (the courier does not carry the parcels around the rooms or around the yard). Shipments with a total weight of 30 kg to 80 kg (several buckets), the courier will only assist in unloading the shipment from the car, but will not assist in carrying it to the desired location;
5.2. Orders generally arrive at their destination within 2-7 working days in Estonia, 3-10 working days in Finland from the entry into force of the sales contract. When ordering in Finland, the shipping method is the Itella/Smartpost parcel machine.
5.3. In exceptional cases, Palkmajakeskus reserves the right to deliver the ordered goods within 45 calendar days.
5.4. If the customer has mistakenly chosen the wrong parcel machine for delivery and the package is returned or the customer wants the package redirected to another parcel machine, a one-time service fee of 9.90 euros (including VAT) will apply, for which Palkmajakeskus will issue a separate invoice to the customer for payment. If the package is sent again (e.g. the customer did not take the order out of the parcel machine in time), a one-time service fee of 5.90 euros will be applied.
5.4. The delivery terms shown in the online store are valid from the moment of payment for the order.
5.5 The customer must be diligent, select the desired parcel machine and provide true and valid data when placing the order.
5.6. Palkmajakeskus is not responsible for delays, failures or interruptions in the delivery of goods if they are due to circumstances that Palkmajakeskus could not influence or foresee.
6. Right of withdrawal
6.1. After receiving the order, the customer has the right to withdraw from the contract concluded in the online store within 30 days. The right of withdrawal does not apply to legal entities.
6.2. The right of withdrawal does not apply to the delivery of a product in a sealed package that is not suitable for return due to health protection or hygiene reasons and if the product is opened after delivery and in other under the conditions listed in §53 of VÍS (except for campaigns organized by the manufacturer, in which Palkmajakeskus participates).
6.3. The returned product must be complete and complete. If the product has been purchased as part of a campaign, where another product (or products) has been added to the product, these products must also be returned.
6.4. In order to make sure of the nature, characteristics and functioning of the goods, the customer must handle and use the product only as he would normally be allowed to do in a physical store. If the product has been used for a purpose other than what is necessary to ensure that the above list is provided, or the product shows signs of use, wear and tear, Palkmajakeskus has the right to reduce the refundable purchase amount according to the decrease in the value of the product. To return the entire purchase amount, the product must be in its original packaging and unused.
6.5. In order to return the goods, you must submit a free form withdrawal from the purchase of the goods and send it to the address info@palkmajakeskus.ee within 30 days of receiving the goods at the latest. The cost of returning the product is borne by the buyer, unless the reason for the return is that the product does not match what was ordered.
6.6. The customer must return the goods within 14 days from the moment of submission of the application or prove in writing that he has handed over the goods to the transport company within the specified period (provide a tracking number).
6.7. Upon receipt of the returned goods, Palkmajakeskus will return all fees received from the buyer under the contract to the buyer without delay, but no later than 14 days after receiving the withdrawal request. Palkmajakeskus may refuse to make refunds until it has received the item that is the subject of the contract or until the buyer has provided evidence that it has returned the item, whichever occurs first.
6.8. All costs of directly withdrawing the goods are borne by the customer. If the customer has chosen a more expensive delivery method than the cheapest delivery method, Palkmajakeskus does not have to refund the cost that exceeds the cost of the usual delivery method.
6.9. Palkmajakeskus has the right to withdraw from the transaction and demand the return of the goods from the customer, if the price of the goods in the e-store was significantly lower than the actual market price of the goods due to a mistake.
7. Force majeure
7.1. Palkmajakeskus is not responsible for damages caused to the customer or delay in delivery of goods if the damage or delay in delivery of goods is due to circumstances that Palkmajakeskus could not influence or foresee.
8. Processing of personal data
8.1. The personal data processing principles applicable when ordering from the Palkmajakeskus online store can be found here - Privacy Policy.
8.2. With the corresponding confirmation in the online store, the customer gives Palkmajakeskus the right to collect and process personal data (name, contact phone number, parcel delivery and/or home address, e-mail address) and forward personal data to logistics partners for the delivery of goods.
8.3. Palkmajakeskus has the right to use the customer's contact details to transmit important information.
8.4. The customer has the right to prohibit the collection and use of his personal data at any time, unless it is necessary to collect a claim arising from the contract or to deliver the goods.
8.5. Encrypted data communication when paying for purchases with banks ensures the security of personal bank credentials, and Palkmajakeskus does not have access to them either.
8.6. The customer has the right to demand in writing from Palkmajakeskus to delete his customer data from the online store system.
9. Claim submission procedure
9.1. Palkmajakeskus is responsible for the non-compliance of the goods sold to the customer with the contract conditions or defects that appear within 2 years from the handover of the goods. For legal entities, we allow a 3-month claim submission period.
9.2. The customer has the right to submit a claim for the delivered product for two years by presenting the purchase invoice on paper or digitally (e.g. as a PDF). In the event of a product defect, Palkmajakeskus must be contacted within two months from its discovery. Notification of non-conformity of goods must be sent to the e-mail address info@palkmajakeskus.ee. In the event that the customer does not inform about the non-conformity of the goods within the terms and time limit set forth in this clause, Palkmajakeskus is released from responsibility for the non-conformity of the goods.
9.6. Palkmajakeskus is responsible for non-compliance of the goods and defects that appear within 2 years from the handing over of the goods to the customer as follows:
- during the first twelve months from the moment of delivery of the goods, it is assumed that the non-conformity of the goods already existed at the moment of the delivery of the goods, so Palkmajakeskus is responsible for proving the conformity of the goods with quality.
- after twelve months have passed from the moment of delivery of the goods, the responsibility of proving non-compliance with the quality of the goods rests with the customer.
9.7. Palkmajakeskus and the customer agree on the repair or replacement of defective goods. The product will be repaired or replaced as soon as possible. The customer bears the costs of transporting the product to Palkmajakeskus or the service center.
9.8. Palkmajakeskus is not responsible for defects in the goods caused by the customer's fault, which have arisen as a result of improper storage or use of the goods.
9.9. In the event of non-compliance or defects of the goods, a claim must be sent to the e-mail address info@palkmajakeskus.ee, where the name of the submitter, contact telephone number, order number and the most detailed and relevant description of the non-compliance or deficiency of the goods must be indicated.
9.10. The claim regarding the non-compliance of the goods or the discovery of defects must be submitted immediately, as soon as possible after the discovery of the lack of non-compliance of the goods.
9.11. All claims are reviewed and the customer is contacted as soon as possible, but no later than within 15 calendar days from the receipt of the claim.
9.12. The customer has the right to make a proposal to Palkmajakeskus to reduce the purchase price or terminate the contract and ask for a refund for the goods, if Palkmajakeskus is unable to repair or replace the goods, or the repair or replacement of the goods fails.
10. The customer's right to appeal to the Consumer Complaints Commission
10.1. If Palkmajakeskus has refused to resolve the customer's complaint, or if the customer does not agree with at least two solution proposals proposed by Palkmajakeskus and considers that the customer's rights have been significantly violated or the customer's interests have been damaged, the customer may submit a complaint to the Consumer Complaints Committee through the Consumer Protection and Technical Supervision Agency. The customer can file a complaint himself or through his written representative. The data of the Commission for Consumer Protection and Technical Supervision are provided on the website, to solve problems arising in the member states of the European Union, contact the European Union Consumer Advisory Center on the website.
